1. About this policy

This Privacy Policy describes how Foodrx Ventures Pty Ltd (ABN 91 702 560 138) ("Foodrx Ventures", "we", "us" or "our") collects, holds, uses and discloses personal information. It applies to all interactions with our website at foodrxventures.site and to our food science and nutrition services, including nutrition analysis, product development support, food labelling compliance and regulatory advisory.

By engaging our services or using our website, you agree to the handling of your personal information in accordance with this policy. If you have any questions, please contact us at ceo@foodrxventures.online.

2. The Australian Privacy Principles

We are bound by the Privacy Act 1988 (Cth) and the thirteen Australian Privacy Principles (APPs) set out in that Act. The APPs govern the collection, use, disclosure, quality, security and access of personal information by Australian organisations. This policy is designed to ensure our practices comply with the APPs, including APP 1 (open and transparent management of personal information), APP 5 (notification of collection), APP 6 (use and disclosure), APP 11 (security of personal information) and APP 12 (access to personal information).

3. Personal information we collect

The types of personal information we may collect include:

  • Your name, job title and the name of the business or organisation you represent;
  • Your email address and preferred contact details;
  • Your business address or delivery location within Australia;
  • Information relevant to the food science and nutrition services you request, such as product specifications, recipes, ingredient lists, formulations and packaging artwork;
  • Enquiry details and correspondence you send to us;
  • Billing and invoicing information necessary to provide our services;
  • Website usage information, such as pages visited and the browser or device used.

We do not collect sensitive information (such as health information or dietary requirements tied to an identifiable individual) unless it is reasonably necessary for a service you have expressly requested and you have consented to that collection.

4. How we collect personal information

We collect personal information in the following ways:

  • Directly from you when you complete a form on our website, send us an email, or engage us to provide services;
  • During the course of a project, through correspondence, meetings and the supply of product documentation;
  • Automatically through our website, via cookies and similar technologies (see section 7);
  • From third parties where you have referred us, or where it is unreasonable or impracticable to collect the information directly from you.

Where it is reasonable and practicable to do so, we collect personal information only from you. If we receive information we did not solicit and it is not needed for our functions, we will deal with it in accordance with APP 11, which may include destroying or de-identifying it.

5. Why we collect and use personal information

We collect, hold and use personal information so that we can:

  • Respond to enquiries and provide quotations for our services;
  • Deliver food science and nutrition services, including nutrition information panels, ingredient listings and label compliance reviews;
  • Manage our client relationships, projects, invoicing and business records;
  • Improve our website and services;
  • Comply with our legal and regulatory obligations, including taxation and record-keeping requirements.

We will not use or disclose personal information for a purpose other than the primary purpose of collection, unless you have consented, or the use or disclosure is permitted or required by the Privacy Act or another Australian law. We do not sell personal information, and we do not use client product formulations or commercial-in-confidence material for any purpose beyond the agreed engagement.

6. Disclosure of personal information

We may disclose personal information to:

  • Professional advisers, such as our accountants, where reasonably required for the operation of our business;
  • Service providers who host our website, email or business systems, who process information on our instructions;
  • Government agencies, regulators or law enforcement bodies where required or authorised by Australian law;
  • Any other person with your consent, or where you would reasonably expect the disclosure.

We take reasonable steps to ensure that any third party we engage handles personal information in a manner consistent with the APPs, including through contractual arrangements where appropriate.

7. Cookies and website analytics

Our website may use cookies and similar technologies to function properly, remember your preferences and understand how visitors use the site. Cookies are small text files stored on your device. You can configure your browser to refuse cookies or to alert you when cookies are being used; however, some parts of the website may not function fully without them.

Analytics information collected through the website is used in a de-identified or aggregated form wherever possible, and is not used to identify individual visitors unless required by law.

8. Security and retention of personal information

We take reasonable steps to protect personal information we hold from misuse, interference and loss, and from unauthorised access, modification or disclosure. These steps include access controls on our business systems, secure storage practices, and limiting access to personal information to personnel who need it to perform their duties.

We also take reasonable steps to destroy or permanently de-identify personal information once it is no longer needed for the purpose for which it was collected, unless we are required by law (including taxation and corporate record-keeping laws) to retain it for a longer period.

9. Access to and correction of your personal information

Under APP 12 and APP 13, you have a right to request access to the personal information we hold about you, and to request corrections where that information is inaccurate, out-of-date, incomplete, irrelevant or misleading. To make a request, please email ceo@foodrxventures.online with details of your request.

We will respond to your request within a reasonable period. There is no charge for requesting access or correction, although we may charge a reasonable fee for providing a copy of the information. In limited circumstances, we may refuse a request where permitted by the APPs; if so, we will give you written reasons and information about how to complain.

10. Overseas disclosure

We generally hold and process personal information within Australia. If, in the course of providing services or using cloud-based systems, personal information is likely to be disclosed to an overseas recipient, we will take reasonable steps to ensure the recipient does not breach the APPs, and we will inform you of the likely countries of receipt where required under APP 8.

11. Anonymity and pseudonymity

Where it is lawful and practicable, you have the option of dealing with us anonymously or using a pseudonym, for example when browsing our website or making a general enquiry. However, in most cases we need your name and contact details to provide quotations, deliver services or respond to project correspondence.

12. Complaints and feedback

If you believe we have breached the Australian Privacy Principles or mishandled your personal information, please send your complaint to ceo@foodrxventures.online. Please include enough detail for us to investigate, such as what information you believe was mishandled and how.

We will acknowledge your complaint promptly and aim to provide a written response within 30 days. If you are not satisfied with our response, you may escalate the matter to the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au. The OAIC may be contacted through its website for guidance on making a privacy complaint.

13. Changes to this policy

We may update this Privacy Policy from time to time to reflect changes in our practices, services or legal obligations. The current version will always be published on this page, with the date of the latest revision shown at the top. We encourage you to review this policy periodically.
